On this day, came to be considered the Motion to Dismiss (the “Motion”) filed by
Defendant Ten-X, Inc. (“Ten-X”). After considering the Motion, the response filed by the Kaz
Meyers Plaintiffs (if any), the reply filed by Ten-X (if any), the arguments of counsel, and any
evidence properly before the Court, the Court is of the opinion that the Motion should be granted.
It is therefore ORDERED that: (1) the Motion is hereby GRANTED and (2) all claims
asserted by the Kaz Meyers Plaintiffs against Ten-X are DISMISSED with prejudice to re-filling
within the State of Texas.
