                entitled action, and

                          NOW,    upon reading the Affidavit of Plaintiff, pleadings and proceedings filed

                and had herein, and the Erie County Attorney's Office having made [ ] no objection or

                [ ] made objection to Plaintiff application to proceed as poor person, it is

                          NOW, the Court, after due deliberation having been had thereon, it is,

                          ORDERED,     that Plaintiff request to Proceed as Poor Person and seeking

                Waiver of Filing and Service fees and costs in the above-captioned action, including filing

                of any Notice of Appeal in the Erie County & Supreme Court in event of termination of the

                action not in favor of the Plaintiff, be and the same is hereby in all respects granted, and

                it is further;

                           ORDERED, that in the event the Plaintiff shall recover a monetary award in this

                action be it through settlement or trial, that Plaintiff shall be responsible to reimburse

                the County of Erie for all costs and expenses associated with this Order granting him

                poor person status.
