Dear Judge Cerio:
In regards to your Memorandum from yesterday, attached hereto is an e-mail which this
office sent to Assistant Attorney General Mulvey on February 10, which was the day of his letter
to your Honor.
As stated,therein, we advised Mr. Mulvey that in fact the Petition did have an appraisal
attached at Exhibit "10". We asked Mr. Mulvey that in light of this, would he approve the
Petition so that we could move forward with our closing. It was our intention at that time to
address Mr. Mulvey's oversight with him privately in the interest of professional courtesy.
We have heard nothing back from Mr. Mulvey. It isrespectfully submitted that had Mr.
Mulvey read the Petition, he would have clearly seen that his letter to your Honor on February 10
was incorrect and not factual
It isand remams our position that an appropriate appraisal from a licensed appraiser-was
provided in the Petition filed with the Court.
As such, we reiterate our request for approval from the Assistant Attorney General.
