COMES NOW Sunbelt-CSX, LLC, Plaintiff, in the above-styled and numbered cause, and
moves this Court for an Order of Nonsuit for this case against Defendant, Montgomery Central
Appraisal District, and in support thereof shows that Plaintiff (i) no longer desires to prosecute its
claim set out in its pleadings on file in this cause and (ii) consequently, no controversy exists
among the parties to this cause.
WHEREFORE, Plaintiff, requests this Court to enter an Order of Nonsuit with prejudice
and all costs herein incurred shall be borne by the party incurring same.
