UNIVERSAL PROPERTY & CASUALTY INSURANCE COMPANY DEFENDANT. __________________________________/ COMPLAINT COMES NOW, the Plaintiff, MARIE PIERRE (hereinafter referred to as “Plaintiff”), by and through undersigned counsel, and hereby sue the Defendant, UNIVERSAL PROPERTY & CASUALTY INSURANCE COMPANY (hereinafter referred to as the “Defendant”), and in support thereof alleges as follows: JURISDICTION AND VENUE 1. This is an action for the amount of $121,916.67, exclusive of attorney fees, costs, and interest. 2. At all times material hereto, Plaintiff is and was the owner of the property located at 18130 NW 9th Ave. Miami FL 33169, and is otherwise sui juris. 3. That at all times material hereto, the Defendant was and is a corporation duly licensed to transact business in the State of Florida and maintained agents for the transaction of its customary business throughout the State of Florida and is otherwise sui juris. 4. Venue is proper in MIAMI-DADE County, Florida because the contract, which forms the subject matter of this lawsuit, was executed in MIAMI-DADE County, Florida. COUNT 1-BREACH OF CONTRACT The Plaintiff re-alleges and re-affirms the allegations contained in paragraphs 1-4 as though fully alleged herein, and further alleges as follows. 5. At all times material hereto, in consideration of a premium paid by the Plaintiff, there was in full force and effect a certain homeowner’s insurance policy issued by the Defendant, policy number 1501-1506-4343 (hereinafter referred to as the “Policy”). 6. The Defendant is in possession of the policy and it will be made available during discovery. 7. Defendant’s Policy is an “all risk” policy that covers all direct physical losses to the Property that are not otherwise expressly excluded. 8. Under the terms of the Policy, the Defendant agreed to provide insurance coverage to the Plaintiff’s property, including but not limited to coverage to protect against water damage. 9. On or about 05/10/2020, while the Policy was in full force and effect the Property was damaged by water (hereinafter referred to as the “Loss”). 10. On 05/10/2020, said Policy of insurance described above was in compliance with Florida law and in full force and effect. 11. The Defendant acknowledged the Loss with the claim number believed to be FL20- 0115940 and assigned an insurance adjuster to adjust the Loss. 12. The Plaintiff has suffered damages in the amount of $121,916.67. (See Exhibit “A”). 13. The Defendant paid $0.00. 14. The amount in controversy is $121,916.67. 15. Plaintiff has complied with all conditions precedent to entitle Plaintiff to recover under the policy or the conditions have been waived. 16. All duties owed to Defendant pursuant to the policy of insurance have been performed or the duties have been waived. 17. Despite the demand for payment, Defendant has failed or refused to pay the benefits owed to the Plaintiff under the terms of the insurance policy issued by the Defendant. 18. Defendant’s refusal to provide necessary reimbursement for a covered loss in accordance with the insurance contract issued by the Defendant, and otherwise make Plaintiff whole, is a breach of contract. 19. Plaintiff has been damaged as a result of Defendant’s breach in the form of insurance proceeds that have not been paid, interest, costs, and attorney’s fees. 20. As a result of Defendant’s breach of contract, it has become necessary that Plaintiff retain the services of the undersigned attorney. 21. Plaintiff has been and remains fully prepared to comply with the obligations pursuant to the aforesaid contract of insurance. 22. Plaintiff is entitled to recover attorney’s fees and cost under Florida Statute §627.428. WHEREFORE, the Plaintiff demands judgement against the Defendant for: insurance benefits; attorney fees, interest, statutory penalties and costs pursuant to Florida Statute §627.701 et seq. and §627.428.
