Upon reading and filing the Summons and Complaint of the action filed herein on
January 28, 2021, and upon the affirmation of SCOTT T. BIELICKI, ESQ., attorney of record
for plaintiffs, STEVEN DAILEY and YVETTE DAILEY, which affirmation is dated July 8,
2021, and the exhibits thereto annexed, from all of which it appears that this action was brought
to foreclose a mortgage on real property situated in Munnsville, County of Madison, that the
whole amount secured by said mortgage is due and it appearing that all defendants were duly
served with the Summons and Complaint, and that none have answered.
NOW, on motion of SCOTT T. BIELICKI, ESQ., attorney for the plaintiff, it is
ORDERED, that the names of defendants “John Doe” and “Jane Doe” be severed and
stricken from the caption herein and that the action be discontinued as to them, all of the
foregoing without prejudice to any of the proceedings heretofore had or to be had in this action;
and it is further
ORDERED, that this action be and the same hereby is referred to ________________,
Esq. of _____________________, New York to ascertain and compute the amount due to the
plaintiff herein for principal, interest, water and sewer rents, if any, insurance premiums, if any,
and other charges on the note and mortgage mentioned in the Complaint and to examine and
report whether the mortgaged premises can be sold in one parcel.
