CASE NO. 2010 DR 00411 PLAINTIFF vs. JUDGE: DENISE L. CROSS LEO C LUCAS II ORDER SCHEDULING DEFENDANT PRETRIAL CONFERENCE/TRIAL PRETRIAL: Pursuant to Mont. D.R. Rule 4.19, this case has been scheduled for a 15-minute pretrial conference on_July 22, 2010 at 9:15 a.m. Both counsel shall be present in chambers of the assigned Judge at the Dayton-Montgomery County Courts Building, 2" Floor, 301 West Third Street, Dayton, Ohio 45422-4248. While the pretrial conferences may be limited to counsel and the assigned Judge, the parties must be present to discuss any unresolved issues, unless excused for good reason. Counsel shall have access to their calendars to facilitate any scheduling issues. DISCOVERY: Mandatory disclosure and discovery shall be completed seven (7) days prior to the pretrial conference pursuant to Mont. D.R. Rule 4.18. Counsel are expected to have exchanged settlement proposals and to have personally discussed all disputed issues prior to the pretrial conference. CONTINUANCE OF PRETRIAL: Continuance of a pretrial conference must be requested BY MOTION sent simultaneously to the judge's bailiff and to opposing counsel or pro se party. The motion shall set forth the pretrial and trial dates, the nature of the conflict in dates, the case number, and the names and phone numbers of both counsel. The bailiff will call both counsel to reset the pretrial conference. TRIAL: Trial is hereby set on September 09, 2010 at 9:30 am.. All parties and counsel are requested to be present 30 minutes prior to that time. [At least three other contested cases have been set on this date.] CONTINUANCE OF TRIAL: Continuance of a trial must be requested by MOTION, if made before the pretrial date; the motion shall set forth the pretrial and trial dates, the nature of the conflict in dates, the case number, and the names and phone numbers of both counsel. After the pretrial date, continuance of a trial must be by MOTION with a proposed entry which complies with Mont. D.R. Rule 4.20, and is filed with the Clerk of Courts.
