This matter came before the Court on the Motion to Dismiss filed by Defendants
Robertson Construction Services, Inc. and Fidelity Deposit Company of Maryland. The parties
have agreed that rather than having this case dismissed, that this case should be transferred for
further proceedings to the Licking County Court of Common Pleas, the venue provided for in the
Subcontract between the parties. Therefore, upon agreement of the parties and for good cause
shown, this case is hereby transferred to the Licking County Court of Common Pleas as the
proper venue for this action. Plaintiff shall bear any Court costs related to the transfer of this
case to the Licking County Court of Common Pleas. The Motion to Dismiss is hereby rendered
moot.
