Plaintiff (s),by the undersigned Attorney, alleges:
1. Plaintiff is a National Banking Association, licensed to conduct business in New York, with a place
of business at 45-49 Court Street, Canton, County of St. Lawrence, State of NY.
2. Upon information and belief, at alltimes hereinafter mentioned, defendant(s) JustinA Battle is/are
an individual(s) with a residence at 1110 Linwood Pl Utica, NY 13501.
3. There is due and owing to the Plaintiff by the Defeñdañt(s), the sum of $10,208.09 which includes
the principal sum of $7,894.50, accrued but unpaid interest as of December 9, 2020 in the sum of
$1,046.33, accumulated late charges of $192.26 and repossession fees of $1,075.00, plus interest at the
rate of 8.290% from January 15, 2021 by reason of the Defendant's default in the payment pursuant to
the terms of a Retail Instalment Contract and Security Agreement dated August 24, 2018.
4. That although payment has been demanded of the Defendant(s) by the Plaintiff, such has been
neglected and refused and/or denied, Plaintiff has been damaged in the total amount of TEN
THOUSAND TWO HUNDRED EIGHT AND 09/100 DOLLARS ($10,208.09), plus future interest on
the principal balance from December 9, 2020.
WHEREFORE, Plaintiff demands judgment against the Defendant(s), for the total amount claimed due
herein together with reasonable attorneys fees, if provided by contract and allowed by law and the costs
and disbursements of this action, and whatever additional relief the Court deems just, proper and
equitable, less payments made.
