ASSENTED-TO MOTION TO RESCHEDULE HEARING FOR DEFENDANTS’ MOTION FOR JUDGMENT ON THE PLEADINGS Now come the parties by mutual assent, and move this honorable Court to reschedule the hearing for the Defendants, City of New Bedford and Renee Fernandes-Abbott’s, Motion for Judgment on the Pleadings. On December 11, 2018, a hearing was set on Defendants, City of New Bedford and Renee Fernandes-Abbott’s, Motion for Leave to File Motion for Judgment on the Pleadings Pursuant to Mass. R. Civ. P. 12(C). The hearing is currently scheduled for February 5, 2019, a date during which the Town’s counsel will be on trial in the United States District Court in the matter of Pamela Higgins vs. Town of Concord, et al., C.A. No. 1:16-cv- 10641-DLC. All counsel are available on Re 19, or at a date convenient for the Court thereafter. WHEREFORE, the parties and the proposed party respectfully request that this Honorable Court reschedule the hearing for March 5, 2019, or an available date thereafter convenient for the Court’s schedule.
