entitled action, and being the Court otherwise fully advised in the premises, it is hereby,
ORDERED AND ADJUDGED that:
Counts I of Plaintiff's Complaint is hereby dismissed without prejudice.
Plaintiff shall file an Amended Complaint as to Count II striking
paragraphs 29, 30, and 31 within ten (10) days of this Order. Defendant shall
respond within twenty (20) days of receipt of the Amended Complaint.
