PARTIAL OBJECTION TO MOTION FOR DISTRIBUTI
ON / RELEASE OF FUNDS
Now comes the Defendants Susan B. Amato and Rosema
ry Hinton and object to any distribution to Scott
Cook on the following grounds:
1 Scott Cook is not a party to this case and has no standi
ng to request such a distribution unless
he joins as a partyto this case.
Doris Geer lived on the property located at 31 Mt.
Vernon Street, Malden, MA. from 2001-to
2016 and by her own admission never paid rent while living
on the premises.
Doris received rental income from the multi-family home
and it was her responsibility to pay
real estate taxes and loan payments to the Malden Redev
elopment Authority from the rental
income that she received.
Doris failed to pay real estate taxes and the loan to the
M.R.A, and as a result the M.R.A. was
prepared to foreclose on the property.
The Defendants Susan Amato and Rosemary Hinton: paid
$95,591.16 to the City of Malden on
December 18, 2013 to avoid the foreclosure.(The Defend
ants wi ere paid back at the closing of
the property in 2018)
The Defendant Doris Geer alleges that she borrowed
$10,000.00 from her boyfriend Scott Cook
because she was unable to pay taxes on the Property
from the rental income that she was
teceiving. The Defendants Susan Amato and Rosemary
Hinton state that any payments to Scott
Cook should be deducted ONLY from any share distributed
to Doris Geer, because her
borrowing the $10,000.00 as she alleges was only necess
ary because’she failed to pay the taxes
from the rental income that she was receiving while she
lived rent free on the property; and
further the Defendants Amato and Hinton objects to
paying any loan back when they held
ownership interests in the real estate and were never consul
ted prior to the alleged loan being
made.

For all of the above reasons, the Motion for Distribution/
Release of Funds should be partially
denied as it relates to any distribution being made to
Scott Cook.
