JAYSON FREDETTE, et. al, CLERK/MAGISTRATE Defendant AFFIDAVIT OF MICKAYLA SHEPARD IN SUPPORT OF MOTION FOR DEFAULT JUDGEMENT AGAINST JAYSON FREDETTE I, Mickayla Shepard, plaintiff in the above entitled action, state that I have reviewed the first amended complaint in this matter and the contents therein are true to the best of my memory and belief. | further summarize the facts as they relate to Jayson Fredette as follows: Jayson Fredette and Susan Paulovich entered into a contract to sell the property located at 967 Huntington Road, Worthington, Massachusetts to Jonathan Serveilo and me for the sum of $205,000.06. The sale was io be a short sale and the sellers’ bank had agreed to participate in the short sale and discharge the mortgage upon receipt of the proceeds of the short sale. There were a number of delays in the closing of this property, however it was scheduled to occur on October 4, 2016. Jayson Fredette signed a warranty deed to us dated September 26, 2016 and Susan E. Paulovich signed a warranty deed to us dated September 16, 2016. That deed was provided to our lawyer and is in the possession of our attorney who agreed to hold the deed in escrow until the closing date. On the date of the closing it was discovered that an execution on money judgment for money damages had been recorded on September 27, 2016 against the seller, Susan Paulovich, and due to the intervening lien, the closing did not take place.
