Now come the plaintiffs in the above entitled matter who state that
this complaint involves a claim (among other claims) for specific
performance of a contract to sell real estate located at 967 Huntington
Road, Worthington, MA 01098, owned by defendants Jayson Fredette and
Susan E. Paulovich, and the failure to perform the contract for sale, all as
set forth in the complaint filed in this action.

In order to protect the plaintiffs claim to title and to insure that any
prospective purchaser of this property is aware of the claim for title
asserted by the plaintiffs, the plaintiffs request permission to record a notice
of Lis Pendens in the Hampshire County Registry of Deeds.
Wherefore, the plaintiffs move this court to allow them to file the
attached Notice Of Lis Pendens.
