Declaration of Petitioner in support of: Facts upon which petitioner bases the
allegation that the property described in Attachments 7a is property that should pass
or be confirmed to petitioner as the surviving spouse.
i I am the Petitioner and surviving spouse ofJ Jesus Rangel Macias a.k.a., Chuy-
Rangel Macias (“decedent”).
The decedent and I were married on December 08, 2010 (a true and correct copy
of our marriage certificate is attached hereto) and remained married until the
decedent’s death on November 22, 2020 (a true and correct copy of the
decedent’s death certificate is attached hereto).

The decedent and I purchased the real property at issue herein located at 412 Mt.
11 Everest Court, Modesto, CA 95358 (“Mt. Everest Court Home”) on October 24,
2014. (See copy of 2014 Grant Deed attached hereto). We were married at the time
12 of purchase but title was only taken the name of the decedent.

The title was taken only in the name of the decedent because I did not have good
14 credit. In order to obtain the loan I had to sign an Interposal Transfer Grant Deed (a
true and correct copy is attached hereto) at the same time as execution of the 2014
15 Grant Deed to the Decedent. This document was never explained to me but I was
told that because I did not have good credit and because I was not employed (I was
16
the homemaker throughout the marriage but did not work outside of the home) that I
a could not be on the loan or title to the Mt. Everest Court Home.
18 Despite the fact that title was taken only in the name of the decedent the Mt. Everest
Court Home at issue herein was purchased during our marriage and it was paid for

from the employment funds of the decedent which was our sole source of income
20 during the marriage. Furthermore, I have and continue to pay all costs, taxes,
insurance for the Mt. Everest Court Home.

The decedent and I understood that the Mt. Everest Court Home to belonged to us
both. It was our desire and intent to pay off the loan quickly and add me on title to
23 the home as wife to the decedent. We budgeted and sacrificed monthly so that larger
payments could be applied to the home loan.
