IN THE CIRCUIT COURT OF THE 11TH JUDICIAL CIRCUIT IN AND FOR MIAMI- DADE COUNTY, FLORIDA AMIAMI INVESTMENTS, LLC, Plaintiff, CIRCUIT CIVIL DIVISION vs. CASE NO. 2017-013319-CA-01 DYC CAPITAL 16 LLC, a Florida SECTION 34 limited liability company, et al., Defendants. / AGREED ORDER ON PLAINTIFF’S MOTION FOR TELEPHONE / VIDEOTAPE DEPOSITION & FOR APPOINTMENT OF COMMISSIONER THIS CAUSE having come on before this Court for a supplemental order on “Plaintiff's Motion For Protective Order; For Telephone Or Video Deposition; For Appointment Of Commissioner; And For Use Of Communication Equipment To Take Testimony Renewed Motion For Telephone / Video Deposition & For Appointment of Commissioner,” (Clerk’s filing # 67278730) which was heard on April 25, 2018; and the Court having reviewed the motion and being advised that the parties are in agreement for the entry of this order, IT IS HEREBY: ORDERED AND ADJUDGED as follows: 1. The deposition(s) of the Plaintiff's representative, Amnon Bensimon, who resides in Israel may be taken (nearest his place of residence) via telephone or phone & video at the option of the party noticing the deposition. 2. The Plaintiff shall bear the initial cost for the phone conference line and the attendance of the court reporter and videographer of the deposition taken by the Defendant, Gratsiani. 3. Acourt reporter from Optima Juris, an international deposition agency, or from any other deposition agency as may be arranged by Plaintiff, is hereby appointed as Commissioner to take the deposition(s) in Israel of Plaintiff's representative, Mr. Bensimon, and is hereby authorized to: (i) administer the oath to Mr. Bensimon for the taking of his deposition(s) or to take the deposition before a person who is otherwise authorized to administer an oath in Israel; (ii) to transcribe the testimony of the deponent and (iii) to transmit the original and copies of the transcript and/or videotape of the deposition(s) at the expense of the requesting attorney(s).CASE NO. 2017-013319-CA-01 SECTION 34 4. Acopy of this Order shall, for all purposes, serve as a formal Commission for the taking of the deposition(s) of the Plaintiff's representative, Mr. Bensimon, in Israel. 5. In addition, the Clerk, shall issue a Commission in compliance with this Order in substantially the form attached hereto. DONE AND ORDERED in Chambers at Miami-Dade County, Florida, on 09/19/18.
