MOTION TO DISSOLVE WRIT OF GARNISHMENT.
Defendant hereby requests that the Court enter an order dissolving the writ of garnishment in the
above-styled action pursuant to Fla. Stat. § 77.07 and states that when Plaintiff moved for a writ of
garnishment, it submitted to the Court that it possessed a judgment. This was an untrue statement
because the judgment obtained is void ab initio for failure to conduct notice a hearing on unliquidated
damages. As such, the writ of garnishment must be dissolved pursuant to Fla. Stat. § 77.07.
WHEREFORE, Defendant requests that the Court enter an ord caung the Default Judgment,
dissolving the writ of garnishment, and providing any such fup#tér relief deems just and equitable.
