PLAINTIFF —CLERK/MAGISTRATE PLAINTIFF'S MOTION FOR vs. JUDGMENT ON THE PLEADINGS CIVIL SERVICE COMMISSION AND DEPARTMENT OF REVENUE, DEFENDANTS Now comes the Plaintiff, pursuant to Rule 12(c) of the Massachusetts Rules of Civil Procedure and Superior Court Standing Order No. 1-96(4), and moves for judgment on the pleadings in her favor, to the effect that the decision of the Civil Service Commission denying the Plaintiff's reclassification appeal, upon which this action is based, was contrary to the evidence admitted in the record, arbitrary or capricious, not supported by substantial evidence, unwarranted on the record, constituted an abuse of discretion, denied the Plaintiff due process of law and/or was otherwise not in accordance with law. As grounds therefor, the Plaintiff relies on the reasons stated in her Memorandum in Support of Plaintiff's Motion for Judgment on the Pleadings filed herewith, in conjunction with the Administrative Record of the proceedings before the Civil Service Commission in regard to said reclassification appeal ("AR") and the Transcript of the Civil Service Commission hearing which took place on 10/03/2016, 10/06/2016 and 02/02/2017 regarding that appeal ("Tr. v.1, v.2 & v.3"), which have been filed in this action, Q : pursuant to Superior Court Standing Order 1-96(2).
