TIFF’S FIRST REQUEST FOR ADMISSIONS TO DEFENDANT
Pursuant to FLA. R. CIv. P. 1.370, the Plaintiff, OSCAR DIAZ (the “Plaintiff’), hereby
propounds Plaintiff's First Request for Admissions to Defendant, UNIVERSAL PROPERTY &
CASUALTY INSURANCE COMPANY (the “Defendant”), to admit or deny within forty-five
(45) days from the date of service of this request with Summons and Complaint:
DEFINITIONS
1. “Lawsuit” shall refer to the case with the caption OSCAR DIAZ v. UNIVERSAL
PROPERTY & CASUALTY INSURANCE COMPANY.
2. “Claim” shall mean claim number FL20-0117329-N420.
3. “Loss” shall mean the loss that occurred on or about May 18,2020 at the property
located 311 NW 76" Ter, Pembroke Pines, Florida 33024, which is the subject of this Lawsuit.
4. “Policy” shall mean the insurance policy with policy number 1501-1802-2007
issued by the Defendant to the Plaintiff for property address 311 NW 76" Ter, Pembroke Pines,
Florida 33024.
5. “Property” shall mean the property located at 311 NW 76" Ter, Pembroke Pines,
Florida 33024.

1. Admit the Defendant’s legal name has been correctly identified in the Complaint.
2. Admit the Defendant issued the Policy to the Plaintiff covered the Property from
certain losses.
3. Admit the Policy issued to the Plaintiff was in full force and effect on May 18,2020.
4. Admit the Policy issued to the Plaintiff insured against the Loss.
5. Admit the Property sustained physical damage as a result of the Loss.
6. Admit that the Plaintiff complied with all Policy conditions prior to the filing of the
Lawsuit.
7. Admit that the Plaintiff complied with all conditions precedent prior to the filing of
the Lawsuit.
8. Admit that there is physical damage to the Property as a result of the Loss.
9. Admit that the Property sustained damages as a result of the Loss for an amount
greater than the deductible.
10. Admit that the Defendant agrees with the scope of the repairs proposed by the
Plaintiff and attached hereto as Exhibit 1.
11. Admit that the Defendant agrees to pay the Plaintiff an amount in excess of the
deductible for the Loss.
12. Admit that a representative and/or agent of the Defendant inspected the Property
after the Loss and prior to the filing of the Lawsuit.
13. Admit that the Defendant intentionally failed to pay for the damages suffered at the
Property as a result of the Loss in this Claim.
