1. On or about February 03, 2018 in Charlotte County, Florida, did unlawfully drive, or was in
actual physical control of a vehicle, while under the influence of alcoholic beverages, any
chemical substance under 877.111, or any substance controlled under chapter 893, to the extent
that his normal faculties were impaired, or with a blood alcohol level of 0.08 percent or higher,
and by reason of such operation of a vehicle, caused or contributed to causing serious bodily
injury to Diana Wenz, contrary to Florida Statute 316.193,

against the peace and dignity of the STATE OF FLORIDA,
