Defendant.
Plaintiff, coiliplaiiiing of Defendant by itsattorneys, Lacy Katzen LLP, alleges as
follows:
1. Plaintiff is a domestic corporation with an office in Stony Point, Rockland County,
State of New York.
2. Defendant is a resident of Rochester, Monroe County, State of New York.
3. On or about June 4, 2019, Plaintiff loaned Defendant the sum of $6256.00 as
evidenced by a copy of the Retail Instalment Contract ("Agreement") annexed hereto as Exhibit
"A".
4. Pursuant to the Agreeniciit, Defendant agreed to pay to Plaintiff the sum of $263.97
per month commcñcing on July 4, 2019, and monthly thereafter, applied firstto interest and then to
the reduction of the principal.
5. Pursuant to the Agreement, Defendant granted to Plaintiff a security interest in a
2011 Chrysler 200 as security for all amounts owed by Defendant.
6. Defendant defaulted under the terms of the Agrcemcñt and Plaintiff repossessed
Defendant vehicle.
7. Plaintiff thereafter provided Defendant with a Notice of Redemption, a true and
accurate copy of which is annexed hereto as Exhibit "B".
8. Plaintiff sold the vehicle at auction. After crediting Defendant with the proceeds of

the sale and debiting Defendant with the costs and expenses of the sale, there was a balance due and
owing of $4418.04.
9. Plaintiff thereafter provided Defendant with a Notice of Deficiency showing an
accounting of the sale with the allocation of fees and disbursements comprising the balance.

10. After giving credit to Defendant for allpayments made and credits received, there is
now due and owing from Defendant to Plaintiff, on account thereof, the sum of $4411.24.
11. Pursuant to the Agreement, Defendant is liable to Plaintiff for expenses in collecting
attorneys'
the loan, including fees and costs.
12. On or about March 26, 2020, Plaintiff referred this account to Lacy Katzen LLP who
is not an employee of the Plaintiff.
13. By reason thereof, there is an additional amount due and owing from Defendant to
attorneys'
Plaintiff as and for reasonable fees as deteññiñed by this court.
WHEREFORE, Plaintiff demands judgment against Defendant for the sum of
attorneys'
$4411.24, and fees as awarded by the court, plus the costs and disbursements of this
action.

Plaintiff, coiliplaiiiing of Defendant by itsattorneys, Lacy Katzen LLP, alleges as follows: 1. Plaintiff is a domestic corporation with an office in Stony Point, Rockland County, State of New York. 2. Defendant is a resident of Rochester, Monroe County, State of New York. 3. On or about June 4, 2019, Plaintiff loaned Defendant the sum of $6256.00 as evidenced by a copy of the Retail Instalment Contract ("Agreement") annexed hereto as Exhibit "A". 4. Pursuant to the Agreeniciit, Defendant agreed to pay to Plaintiff the sum of $263.97 per month commcñcing on July 4, 2019, and monthly thereafter, applied firstto interest and then to the reduction of the principal. 5. Pursuant to the Agreement, Defendant granted to Plaintiff a security interest in a 2011 Chrysler 200 as security for all amounts owed by Defendant. 6. Defendant defaulted under the terms of the Agrcemcñt and Plaintiff repossessed Defendant vehicle. 7. Plaintiff thereafter provided Defendant with a Notice of Redemption, a true and accurate copy of which is annexed hereto as Exhibit "B". 8. Plaintiff sold the vehicle at auction. Plaintiff thereafter provided Defendant with a Notice of Deficiency showing an accounting of the sale with the allocation of fees and disbursements comprising the balance. After giving credit to Defendant for allpayments made and credits received, there is now due and owing from Defendant to Plaintiff, on account thereof, the sum of $4411.24. 11.
