The facts upon which Petitioner bases the allegations that (i) the property interests
described in Attachment 7a are property that should pass to the surviving spouse are as follows:
Petitioner is the surviving spouse of the Decedent. Petitioner and the decedent were
married for over 20 years. They married on July 2, 1994. The property interests described in
Attachments 7a and 7b are the community property of the surviving spouse and the Decedent.
The interests in the real properties described below were acquired by the Decedent in the 1980s.
The properties were maintained with the community property earnings of the surviving spouse
and the Decedent during their over twenty years of marriage. In 2018, Decedent conveyed his
interest in both of the properties to his wife, Joni (Petitioner or Surviving Spouse).
521 High Street, Modesto, California
The real property located at 521 High Street, Modesto, California, was acquired by
decedent (“Gerald”) and his ex-wife, Norma J. Bradley (“Norma”), as “Gerald A. Bradley and
Norma J. Bradley, Husband and Wife, as joint tenants” on or about November 5, 1970. Gerald
and Norma were divorced on December 6, 1978. Pursuant to the Amended Judgment of
Dissolution entered Nunc Pro Tunc on April 28, 1988, Gerald and Norma were each awarded an
undivided one-half interest, as tenants in common, in the High Street property. However, as of
the date of the Amended Judgment of Dissolution, Norma was deceased, and her one-half
interest in the High Street property was thereafter ordered by the Probate Court to be distributed
to her two adult surviving children, David Wayne Lovett (“David”) and Michael Steven Lovett
(“Michael”), each receiving a one-fourth interest, in the High Street property. The Order Settling
First and Final Account and Report, For Statutory Fees, Costs, Extraordinary Fees and Costs and
For Final Distribution in the Estate of Norma Jean Bradley was entered on December 5, 1988.
From 1988 to 2018, the Decedent, David, and Michael held the High Street property as a rental
home, from which Decedent’s share of income was commingled with the community property
funds of Petitioner. On May 9, 2018, Gerald executed an Interspousal Transfer (Grant) Deed
conveying all of his right, title and interest in the High Street property to his wife, Joni
(Petitioner) which was recorded on June 29, 2018.
After the death of Decedent in November, 2018, David and Michael requested that
Petitioner agree to sell the High Street property. However, because Petitioner did not want to sell
the High Street property, on February 14, 2019, David and Michael filed a civil action against
Petitioner in the Stanislaus County Superior Court (Case No. CV-19-000874) seeking, among
other things, a partition and sale of the property (“the Partition Action”). The Partition Action
was settled between Petitioner, David, and Michael in November, 2019, pursuant to a written
agreement signed by them whereby the parties agreed to sell the High Street property and divide
its sales proceeds amongst them according to their respective ownership interests. In anticipation

of the imminent listing and sale of the High Street property, Old Republic Title Company has
indicated that it is prepared to issue title insurance for the transaction which would vest legal title
as follows: “Joni Annette Bradley, as to an undivided 50% interest and David Wayne Lovett, as
to an undivided 25% interest and Michael Steven Lovett, as to an undivided 25% interest.”
Accordingly, Petitioner is seeking an Order of this Court to confirm her undivided 50% interest
in the High Street property in anticipation of its sale.
1337 Ford Avenue, Modesto, California
The Decedent’s interest in the real property located at 1337 Ford Avenue, Modesto,
California 95350 was acquired by Decedent from his ex-wife, Dixie Dianne Bradley, via an
Individual Quitclaim Deed executed on January 13, 1987 and recorded on March 4, 1987. On
May 9, 2018 Gerald executed an Interspousal Transfer (Grant) Deed conveying all of his right,
title and interest in the Ford Avenue property to his spouse, Joni, which was recorded on June 29,
2018. As stated above, the Decedent’s interest appears to be in Petitioner’s name, however, she
seeks to confirm this. Petitioner currently occupies this home as her personal residence with her
grandchildren and has no plans to sell it.
The property interests described in Attachment 7a are the one-half community property
of the Decedent, and as such should be determined as having passed to the surviving spouse.
The property interests described in Attachment 7b, as the surviving spouse’s community
property, should be confirmed as having belonged to the surviving spouse as her community
property upon the Decedent’s death under Probate Code Sections 100 and 101.

A copy of an email exchange which includes an email dated July 29, 2020, from the
Modesto Branch Manager of Old Republic Title representing that his underwriter is prepared to
issue title insurance for the High Street property sales transaction which would vest legal title as
follows: “Joni Annette Bradley, as to an undivided 50% interest and David Wayne Lovett, as to
an undivided 25% interest and Michael Steven Lovett, as to an undivided 25% interest,” is
