                   PLEASE TAKE NOTICE, that, upon the annexed affirmation of T. MCKINLEY

          THORNTON, ESQ., dated June 12, 2020, and upon all the exhibits hereto, and upon all

          pleadings and prior proceedings herein, the undersigned, on behalf of the Plaintiffs,

          ALEXANDRA OLEYNIK and ALEKSANDR OLEYNIK, will move this Court, before one of

          the Justices, at the Courthouse located at 360 Adams Street, Brooklyn, New York 11201, Motion

          Part, on July 17, 2020, at 9:30 o’clock in the forenoon of that day, or as soon as thereafter as

          counsel can be heard, for an Order:

                  1. Pursuant to CPLR § 3126, striking the answer of defendant BETH ISRAEL

                       MEDICAL CENTER for willfully failing to disclose information which ought to

                       have been disclosed, based on its failure to comply with the Orders dated June 21,

                       2019, and August 7, 2019, or, alternatively, pursuant to CPLR § 3126, precluding

                       defendant BETH ISRAEL MEDICAL CENTER from offering any evidence at the

                       trial of this matter based thereupon; and

                  2. Pursuant to CPLR § 3124, compelling defendant BETH ISRAEL MEDICAL

                       CENTER to comply with the Court Orders dated June 21, 2019, and August 7, 2019;

                     and

                 3. Compelling defendant BETH ISRAEL MEDICAL CENTER to comply with

                     Plaintiffs’ Subpoena Duces Tecum dated February 6, 2020 (Exhibit H), or,

                     alternatively, issuing a judicial Subpoena Duces Tecum compelling production of the

                     same materials at the same location and compelling defendant BETH ISRAEL

                     MEDICAL CENTER to comply with same; and

                 4. Granting Plaintiffs such other and further relief as the Court may deem just and

                     proper.

                 PLEASE TAKE FURTHER NOTICE that, pursuant to CPLR §§ 2214 and 2103(b),

          responsive papers, if any, are to be served so as to be received by the undersigned at least seven

          (7) days prior to the return date of this motion.
