IT IS HEREBY STIULATED AND AGREED, by and between the undersigned
attorneys of record in the above-captioned action, that whereas no party hereto is an infant or
incompetent person for whom a committee has been appointed, and no person not a party has an
interest in the subject matter of the litigation, that all claims, counterclaims, cross-claims or any
other cause(s) of action by or between Plaintiffs, WF Jamaica LLC and TD Bank, N.A., and
Defendants, Zurich American Insurance Company, Facility Source, LLC, and Facility Source
Northeast Services, LLC, in the above-captioned action are hereby discontinued, with prejudice
and without costs to any party as against the other.
IT IS FURTHER STIPULATED AND AGREED, that facsimile or photocopy
signatures shall for purposes of this Stipulation be deemed the same as original signatures and
that this Stipulation may be executed in counterparts.
IT IS FURTHER STIPULATED AND AGREED, that this stipulation may be filed
without further notice with the Clerk of the Court.
