The Court approves a grant 0f imaiunity for JENNY ANDERSON regarding potential criminal
Child Endangennent Case related to drug exposure to the children ofthis suit,JAYDON SIMPSON,
that tested positive for methamphetamine as shown on the drug test results on or about September
23m ,
201 9, in Smith County, ?Fexas, with immunity being limited todmg use admissions made in
the course of participation in the following services provided by the Department of Family and
Protective Services (hereinafier referred to a_s“DFPS”): psychosocial evaluations, psychological
evaluations, psychiatric evaluationsz substafice abuse assessments, substance abuse treatment,
individual counseling, family counseling, couples counseling, individual therapy, family therapy, and
couples therapy.
The Court finds that nothing in the granting ofthis order prohibits the Petitioner, DFPS, from using
the same admissions made in the course of participation in services in any hearing or trial as
evidence in this current suit, Cause no. 19-2377—D, In the Interest of J.S., a child.
The Court further finds that nothing in the granting ofthis order prohibits the JENNY ANDERSON
from being prosecuted for admissions of other crimes or from being prosecuted for any crime that
occurred outside of Smith County, Texas.
The Court further finds that nothing in the granting ofthis order prohibits the State from prosecuting
JENNY ANDERSON for any crime committed for the events surrounding the drug exposure ofthe
child, but only from using admissions regarding drug use made during the course 0f JENNY
ANDERSON’S participation in court-ordered services with DFPS service providers for the above
listed services.
This order is hereby GRANTED.
