This office represents Defendants, Roseville Petroleum, Inc., and Nirmal Singh in the above-
referenced matter.
On August 27, 2018, you ordered this matter to arbitration pursuant to a stipulation between Plaintiff,
Voyager Restaurant Group, Inc. and Defendants Nirmal Singh and Roseville Petroleum, Inc. At that
time, the matter was supposed to be arbitrated by the end of September 2018 or shortly thereafter.
After the order to arbitration, the Plaintiff has made no effort to even schedule the arbitration. Needless
to say, the arbitration did not occur, is not even calendared and there ispresently no effort whatsoever
to move the case forward by the Plaintiff.
I have asked Plaintiff's counsel to dismiss this case several times, but he has not even responded to my
emails. Please set the matter for an Order to Show Cause why the case should not be dismissed for
failure to prosecute or please set the matter for another trial setting conference.
