000002 isexcluded. Counsel stipulate that only the underlined portions of Larry Hole’s testimony (Exhibit 189) were
played for the jury yesterday. Exhibit 191 is marked for identification, which reflect the portion of Kimberly Hole’s
testimony that was played for the jury yesterday. Again, only the underlined portions of this exhibit were played.
Counsel stipulate that only the underlined portions ofThomas Stevenson’s testimony (Exhibit 188) were played for the
jury yesterday. Exhibit 497 is marked for identification. Counsel stipulate Exhibit 497 represents the portion of Dr.

9:10 a.m. The jury is now present. Ms. Todd presents closing argument on behalf of the defendant. Jurors are
admonished and excused for break. Outside of the presence of the jury, scheduling isdiscussed.
10:28 a.m. Recess taken.
10:39 a.m. Court reconvenes with allparties present as stated above. The jury isalso present. Mr. Ratinoff presents
rebuttal closing argument on behalf ofthe plaintiff.
11:14 a.m. The Court provides finalinstructions to the jury.
11:23 a.m. Deputy David Cox is sworn to take charge of the jury, and the jury retires to begin deliberations. The
alternate jurors are placed on telephone standby and excused pending notification from the clerk. Off the record:

Testimony read back to us from Kim Hole on 9/6 at 2:00 p.m. Kim was being interviewed by Mr. Ratinoff. Specifically
interested inthe Motrin she took on Saturday night.
2:34 p.m. The following written response is provided to the jury from the court:
