Case Number: 18-CIV-03110 SUPERIOR COURT OF SAN MATEO COUNTY 400 County Center 1050 Mission Road Redwood City, CA 94063 South San Francisco, CA 94080 www.sanmateocourt.org Minute Order SWEET PRODUCTION, INC., A CALIFORNIA CORPORATION vs. 18-CIV-03110 SOLOMON SHA, et al 04/02/2019 9:00 AM Motion to Compel Hearing Result: Held Judicial Officer: Greenberg, Susan Location: Courtroom 2B Courtroom Clerk: Theresa Maragoulas Courtroom Reporter: Annette Jaycox Parties Present Exhibits Minutes Journals - No appearance by any parties herein or their counsel of record. Tentative ruling adopted and becomes order: MOTION TO COMPEL DISCOVERY RESPONSES FROM CROSS-DEFENDANTS SWEET PRODUCTION, INC., MING CHIN AND DOREEN CHIN BY SOLOMON SHA The Motion to Compel is denied without prejudice. The Notice of Motion indicates Defendant/Cross- Complainant Soloman Sha seeks to compel responses to discovery from Sweet Production, Inc., Ming Chin and Doreen Chin in their capacity as cross-defendants. However, the court's records reflect that Cross-Defendants' defaults have been entered. Furthermore, Sha has not provided evidence sufficient to establish that the underlying discovery was properly served on Cross-Defendants. The declaration of Carmen Aviles merely states she served the discovery on July 19, 2018. No further information is provided such as method or location of service. If the tentative ruling is uncontested, it shall become the order of the Court, pursuant to Rule 3.1308(a)(1), adopted by Local Rule 3.10, effective immediately, and no formal order pursuant to Rule 3.1312 or any other notice is required as the tentative ruling affords sufficient notice to the parties.
