I, Matthew C. Decker, file this Unoppos
to appear before the Court in this proceeding under the authority of the Rules Governing
Admission to the Bar of Texas, Rule XIX. In support of this motion, I respectfully show the
Court as follows:
1. I am a licensed attorney with the law firm of Alston & Bird LLP, located at 90
Park Avenue, 15th Floor, New York, NY 10016-1387. My office telephone number is
(212) 210-9449 and facsimile number is (212) 922-3949.
2. I ask the Court for permission to participate in this proceeding on behalf of
Defendant Dell Marketing, LP (“Dell”), in association with Jared M. Slade, who represents
Dell. Mr. Slade is a practicing attorney with the law firm of Alston & Bird LLP and is a
member of the State Bar of Texas. Mr. Slade’s State Bar card number is 24060618, and his
office address, telephone number, and facsimile number are: 2828 North Harwood Street, Suite
1800, Dallas, Texas 75201, (214) 922-3400 (telephone), and (214) 922-3899 (facsimile). Mr.
Slade will personally participate in this proceeding.
3. I have not appeared or sought leave to appear in Texas Courts within the last two
years.

4. I am licensed to practice law in the State of New York, the State of New Jersey,
and the following federal courts: the United States District Courts for the Northern, Southern,
and Eastern Districts of New York; and the United States District Court for the District of New
Jersey. I am an active member in good standing in each of those jurisdictions.
5. I have not been the subject of any disciplinary action within the past five years by
either of the Bars of which I am licensed or the courts in which I am admitted.
6. I have not been denied admission to the courts of any State or to any federal court
within the past five years.
7. I am familiar with the State Bar Act, the State Bar Rules, and the Texas
Disciplinary Rules of Professional Conduct governing the conduct of members of the State Bar
of Texas. I will at all times abide by and comply with each of the foregoing as long as this
proceeding is pending and I have not withdrawn as counsel from the proceeding.
8. Attached as Exhibit A is the Non-Resident Acknowledgement Letter from the
Texas Board of Law Examiners that serves as the receipt for payment of the pro hac vice
admission filing fee.
PRAYER
For these reasons, I respectfully request that the Court grant my Motion for Permission to
Participate Pro Hac Vice and allow me to appear before the Court until the conclusion of this
case.
