and Objections to Plaintiffs’ Notice of Taking Deposition Duces Tecum of Defendant's
Corporate Representative and the Court being otherwise duly advised in the premises, it is
hereupon:
ORDERED AND ADJUDGED that:
1. Defendant’s Motion is hereby GRANTED. Defendant's Corporate Representative may bring
documents to the deposition for reference purposes. Use of privileged claim file materials to
prepare for the deposition or refresh recollection during the deposition will not constitute
waiver of any asserted privilege and/or subject the materials to production.
2. Defendant’s Corporate Representative shall not be required to testify as to any privileged
matters subject to a ruling from the Court.
3. Defendant’s Corporate Representative shall not be required to produce the underwriting file
or the privileged portions of the claim file. Any portion of the claim file not produced shall be
