COMES NOW the Plaintiffs, RICARDO CAYOBIT AND ROLAND CAYUBIT (the
“Plaintiffs”), by and through the undersigned attorneys,
and serves this Reply to Defendant’s, UNITED
PROPERTY AND CASUALTY INSURANCE COMPANY (“Defendant”) Affirmative Defenses and
says: The Plaintiffs deny each and every Affirmative Defense asserted by Defendant referenced herein
and demands strict proof thereof. In addition, Plaintiffs state that by Defendant’s own actions and
coverage determination, Defendant has waived the right to raise the Sixth Affirmative Defenses in this
matter and is thus estopped from asserting same as a defense.
