JUDGMENT MOTION
The defendants’ motion for summary judgment was to be considered by the Court today.
The plaintiff did not file a response to the motion but instead filed a motion for continuance. The
Court hereby grants the plaintiff's motion for continuance. The Court invites but does not order
plaintiff to proceed with taking the deposition(s) of defendants and others that might be
necessary to prepare a response to the motion for summary judgment and/or for trial on the
merits. The plaintiff need not and cannot rely on an interrogatory response or other written
statement about whether parties or witnesses will assert constitutional rights not to testify. The
plaintiff is invited to notice such deposition(s), to ask the questions and to cause the witnesses to
answer or assert rights afforded under the constitution after the question is asked. The Court
