DEFENDANT JANICE HAYDEN’S EMERGENCY MOTION TO CANCEL AND
RESET OCTOBER 19, 2016 FORECLOSURE SALE
COMES NOW, Defendant, Janice Hayden, by and through the undersigned counsel,
and would file this Emergency Motion to Cancel and Reset Foreclosure Sale and in
support thereof would state:
1. This is the second request to cancel the scheduled sale in this case.
2. The Defendant has a pending short sale contract being reviewed by the Plaintiff.
3. Plaintiff had previously agreed to a short sale but the buyer walked away from the
contract.
4. The property is in the process of being appraised by the buyers lender.
5. The Defendant’s husband recently passed away and this Defendant needs the
relocation allowance in order to move.
6. This motion is not being filed for purposes of delay.
WHEREFORE, the Defendant would pray that this matter would be heard and an
Order would be entered Cancelling the Foreclosure Sale that is scheduled for October 19,
2016 and awarding such other relief as this Court deems proper.
