COMES NOW, the Plaintiff, ALBERT RICHARDS, by and through the undersigned counsel,
and hereby sues the Defendant, SAFEPOINT INSURANCE COMPANY, for damages and in support
thereof alleges as follows:
JURISDICTION AND PARTIES
1. This is an action for damages under an insurance policy resulting from loss of property in a
value in excess of $15,000, exclusive of costs, interest and attorney’s fees.
2. That at all times material hereto, the Plaintiff was and is a resident of Broward County, Florida
and is otherwise swi juris.
3. The Defendant, SafePoint Insurance Company, was and is a Florida corporation, by and
through its officers, representatives and agents, who conducted business operations in the County of
Broward, State of Florida for the purposes of selling homeowner insurance policies.

4, Plaintiff purchased from Defendant and maintained in full force and effect, by and through the
payments of premiums, a certain homeowner’s insurance policy bearing policy number SPIH0312291-
02-0001 (the “Policy”).
5. Plaintiff does not have a true and complete copy of the Policy, but Defendant does have a true
and correct copy of the Policy. Plaintiff reserves the right to supplement this Complaint by filing a true
and correct copy of the Policy upon receipt from Defendant pursuant to the discovery filed in this
action.
6. Such Policy was issued by the Defendant to the Plaintiff and provided insurance coverage for
the Plaintiff's dwelling located at 3251 NW 15th Street, Fort Lauderdale, FL 33311 (hereinafter the
“Premises”). A copy of the declaration page of such Policy is attached hereto as Exhibit “A” and
incorporated herein by reference.
7. Pursuant to the Policy provisions, Defendant insured, subject to certain exclusions and
conditions, the Plaintiff's property located at the Premises.
8. On or about June 3, 2015, a broken pipe in the bathroom caused a covered loss and substantial
damage to the Plaintiff's property which was covered under the policy of insurance issued by the
Defendant which was at the time of the loss in full force and effect (hereinafter the “Loss”).
9. Plaintiff timely notified the Defendant of the Loss and has otherwise performed all conditions
precedent to recover under the Policy and under the applicable Florida Statutes.
10. Defendant, despite having received and processed such claim, by means of a letter of denial
sent to the Plaintiff, has refused and continues to refuse to pay the Plaintiffs claim. A copy of
Defendant’s denial letter is attached hereto as Exhibit “B” and is incorporated herein by reference11. Plaintiff and/or Plaintiffs representatives forwarded the Defendant an estimate of the damage
incurred by the Plaintiff as a result of the loss. A true and correct copy of the estimate is attached
hereto and incorporated herein as Exhibit “C”.
12. The Defendant has failed to pay the Policy benefits owed to the Plaintiff under the terms of the
Policy.
13, The Plaintiff, as a result of Defendant’s failure to comply with the terms of the policy has
suffered damages.
14. Plaintiff has performed all conditions precedent to filing this action and/or any and all
conditions precedent have been otherwise met or waived.
15. Plaintiff has complied with all post loss obligations set forth in the insurance policy as
requested by Defendant.
16. Plaintiff, as a result of Defendant’s refusal to honor the contractual obligations contained in the
Policy, has been forced to retain the legal services of Militzok & Levy, P.A. for the purposes of
prosecuting the instant matter and such attorneys are entitled to a reasonable attorney’s fees pursuant to
§627.428, Florida Statutes.
COUNT I
BREACH OF CONTRACT
17. Plaintiff re-alleges and re-asserts the aforesaid Common Allegations and incorporates them
herein.
18. The Defendant’s denial of coverage and refusal to pay the full amount of the claim was
contrary to the terms of the Policy and/or Florida law, and was a breach of said contract of insurance.
19. Asa direct and proximate cause of the Defendant’s acts and/or omissions, Plaintiff has been
damaged in an amount to be determined at trial.20. That as a direct and proximate cause of the Defendant’s refusal to pay the Plaintiff's claim, the
Plaintiff has been required to retain the legal services of Militzok & Levy, P.A. for the purposes of
prosecuting the instant matter and such attorneys are entitled to a reasonable attorney’s fees pursuant to
§627.428, Florida Statutes.
WHEREFORE, the Plaintiff demands judgment against the Defendant, SAFEPOINT
INSURANCE COMPANY for damages, including, but not limited to, damage to the Premises, its
contents, loss of use, costs, interest as allowed by law, reasonable attorney’s fees pursuant to §627.428,
Florida Statutes, a trial by jury of all issues triable as a matter of right by jury and such other relief as
this Court deems just and proper.

Dear Albert Richards,
It is our desire to thoroughly investigate every claim which is reported to us and to make payment
for those losses which are covered under your policy.
We have completed our investigation of the above captioned loss. Your claim was reported by a
representative of PICC, Public Adjusters, for water damage sustained in the vicinity of the
bathroom as a result of a plumbing leak reportedly occurring on June 3, 2015. An inspection was
completed by an insurance adjuster representing our company on June 19, 2015. The adjuster was
not shown damage caused a sudden and accidental water discharge from the plumbing in the
bathroom and adjacent dining room. The damage appeared to be the result of long-term seepage
or leakage in the vicinity of the waste pipe vent stack.
To assist with the investigation we assigned Tierra engineering who inspected the damages and
provided the details of their findings in the attached report. Please refer to the enclosed
engineering report for the specific details of the investigation.

Conclusions
Based on Tierra’s evaluation of the subject residence, it is our professional opinion that:
* The water damage surrounding the hallway bathroom is the result of a waste
stack leak resulting from normal aging due to normal use.
o Based on the decayed sections of wood in the exposed wall cavity in
the dining room, the water damage surrounding the hallway bathroom
has occurred over a period of more than 9 months. This conclusion is
consistent with research performed by Dr. Ralph E. Moon, Ph.D.
(Swelling Proof, Evidence for Continuous and Repeated Water
Exposure, dated February 26, 2013, claims-

+ No damage resulting from the reported leak was observed to the floor tile.
Unfortunately, your policy with SafePoint, the SIC HO-3 10 13, does not provide coverage to you
for constant or repeated seepage or leakage of water or wear and tear and deterioration or
inadequate maintenance as shown in your policy on page 12-13 and 15-18 of 33. Please see the
excerpt listed below which states in part:

We insure against risk of direct loss to property described in COVERAGES Aand B
only if that loss is a physical loss to property.

against this claim for any other valid and lawful reason which may later be discovered or made
