CAUSE NO. 2009-77474 PREXUS HEALTH CONSULTANTS, LLC and PREXUS HEALTH, LLC, IN THE DISTRICT COURT Plaintiffs/Garnishors, AMEGY BANK, NATIONAL ASSOCIATION, JPMORGAN CHASE BANK, NATIONAL ASSOCIATION, AND REGIONS BANK, § § § § § § v. § HARRIS COUNTY, TEXAS § § § § § § Garnishees. § 270th JUDICIAL DISTRICT ORDER FOR ISSUANCE OF POST-JUDGMENT WRIT OF GARNISHMENT On December 20, 2013, the Verified Application for Post-Judgment Writ of Garnishment (the “Application”) was filed by Prexus Health Consultants, LLC and Prexus Health, LLC (“Prexus” or “Plaintiffs”), supported by the verification of Richard Roebuck, M.D., for issuance of a post-judgment writ of garnishment. After considering the pleadings and other papers on file with the Court, the Application and Exhibits thereto, and the evidence presented, the Court finds and concludes that Plaintiffs are entitled to a post-judgment writ of garnishment as requested, for the reason that Plaintiffs have satisfied the requirements of TEx. Civ. Prac. & REM. CODE § 63.001 including Section 63.001(3). Further upon review of the pleadings and other papers on file with the Court, the Application and Exhibits thereto, and the evidence presented, the Court further finds and concludes that Plaintiffs have a valid, subsisting judgment against debtors University General Hospital, LP (“UGH”) and Ascension Physician Solutions, LLC (“Ascension”), and further, based upon the information and evidence presented through the Application, finds that UGH and ORDER FOR ISSUANCE OF POST-JUDGMENT WRIT OF GARNISHMENT PAGE 1 150288Ascension do not possess property in Texas subject to execution sufficient to satisfy the judgment. IT IS THEREFORE ORDERED that the Clerk issue a Writ of Garnishment that commands Amegy Bank, National Association, JPMorgan Chase Bank, National Association, and Regions Bank as Garnishees, to appear as required by law and answer on oath what, if anything, each respective Garnishee is indebted to Defendants University General Hospital, LP and/or Ascension Physician Solutions, LLC and in what amounts when the writ was served, and what effects, if any, of University General Hospital, LP and/or Ascension Physician Solutions, LLC each respective Garnishee possesses and did possess when this writ was served, and what other persons, if any, within each respective Garnishee’s knowledge, are indebted to or have effects of University General Hospital, LP and/or Ascension Physician Solutions, LLC. IT IS FURTHER ORDERED that the maximum value of property or indebtedness that may be garnished is $1,176,359.13. Further, the writ shall command Amegy Bank, National Association, JPMorgan Chase Bank, National Association, and Regions Bank NOT to pay to University General Hospital, LP and/or Ascension Physician Solutions, LLC any debt or to deliver any effects, pending further order of this Court, without retaining property of University General Hospital, LP and/or Ascension Physician Solutions, LLC in an amount sufficient to satisfy and equal the maximum value of property or indebtedness that may be garnished as above-ordered. IT IS FURTHER ORDERED that University General Hospital, LP and/or Ascension Physician Solutions, LLC, in order to replevy property garnished pursuant to writ, shall file with the officer who levied the writ a bond, in conformity with the law, in the amount of ORDER FOR ISSUANCE OF POST-JUDGMENT WRIT OF GARNISHMENT PAGE 2 150288$1,176,359.13, unless University General Hospital, LP and/or Ascension Physicians Solutions, LLC files bond in an amount otherwise provided by the law and the Texas Rules of Civil Procedure.
