MOTION TO VACATE JUDGMENT

1. I make this declaration from personal knowledge and could and would be able to
testify thereto if called upon to do so.
2. Iam the president of HOGAN and VEST, INC.. HOGAN and VEST, INC. is
located at 750 Pacific Avenue, in the City and County of San Francisco, California, 94133.
3. HOGAN and VEST, INC., entered into an agreement with the owners of the subject
premises wherein HOGAN and VEST, INC. manages the property located 1115 Taylor Street, #4,
San Francisco, California 94108.
OPPOSITION TO DEFENDANT'S MOTION TO VACATE JUDGMENT AND SUPPORTING DECLARATION 14. Under this management agreement, HOGAN and VEST, INC. is responsible for
managing the day-to-day affairs of the building, including leasing and/or renting the apartments,
collecting rent from the tenants, coordinating maintenance on the property, and handling all accounting
matters for the building owners.
5. Based upon the aforementioned facts, I am the most familiar with the relevant facts of
the above-captioned matter.
6. This is an unlawful detainer action for nonpayment of rent against the Defendant
ARRON WILLIAMS involving the residential premises located at the premises located at 1115
Taylor Street, #4, San Francisco, California 94108.
7. Since I began managing this property this is the fourth unlawful detainer that we
have filed against Defendant ARRON WILLIAMS for non-payment of rent. In 1996 we
previously filed the unlawful detainer Case No. 135142, for non-payment of rent. In 2004 we
previously filed the unlawful detainer Case No. CUD-04-609766 for non-payment of rent. In
2011 we filed Case No. CUD-11-636820 for non-payment of rent. All of the previous cases
were settled with an agreement allowing defendant to pay his unpaid back rent in installment
payments. Unfortunately, soon after the installment payments for back rent were completed and
Case No. CUD-11-636820 was dismissed, defendant again fell behind on his rent and we had to
file this current and fourth unlawful detainer action for non-payment of rent.
8. In November 2012, we settled this current case by again agreeing to allow defendant
time to pay off the unpaid back rent in small installment payments and the parties entered into a
the Stipulation for Conditional Entry of Judgment entered into in open Court on November 20,
2012, executed by the parties and filed with the Court. By the terms of the parties Stipulation,
defendant agreed that he would pay back rent, and daily damages in the total amount of $7,680.00
in monthly installments of $200.00 and pay the monthly rent in the amount of $1,079.50.

9. Defendant initially timely made the installment, however, over time his payments
began arriving late.
10. Defendant failed to pay May 15, 2015 payment of $200.00 and his May 2015 rent
{of $1,079.50.
11. Also J received numerous oral reports from other tenants in the building that
defendant was disturbing them due to loud altercations with his roommate.
12. The San Francisco Police have been called to defendant’s unit on numerous occasions
during the period of the settlement agreement due to altercations between defendant and his sub-
tenant/roommate. A true and correct copy of dispatch records showing that the police have been
called out to the unit for fighting (code 418) is attached hereto as Exhibit “D” and incorporated
: by reference Aerein.
