COMPLAINT
COMES NOW, Plaintiff, RCS RECOVERY SERVICES, LLC, by and through the
undersigned counsel, and sues the Defendant(s) and alleges:
GENERAL ALLEGATIONS
1. This is an action for damages that are in excess of $15,000.00.
2. On January 13, 2006, Defendant(s), Laura Newbery, made, executed and delivered a
Promissory Note to Mortgage Lenders Network USA, Inc. A copy of the Promissory Note is
attached as Exhibit A.
3. Defendant, Laura Newbery , resides or regularly conducts business in Broward County,
Florida.
4. The original lender relinquished ownership of the debt at issue in this matter, and by virtue
of transfers of the debt, Plaintiff is the current owner and holder of the Note with the rights

5. All conditions precedent required to bring this action have occurred or have been
performed.
COUNT I. BREACH OF NOTE
Plaintiff re-alleges and incorporates the allegations contained in the paragraphs contained in
the General Allegations.
6. Defendant(s), Laura Newbery, has defaulted under the Promissory Note by failing to make
the payment due January 1, 2015, and all subsequent payments.
7. Plaintiff declares the full amount payable under the Promissory Note to be due.
8. Defendant(s), Laura Newbery, owes Plaintiff principal of $29,013.17 on the Promissory
Note, together with all costs of collection including reasonable attorney’s fees.
9. Plaintiff is obligated to pay its attorney a reasonable fee for legal services.
10. All conditions precedent to the institution of this action have been waived, performed or
excused,
WHEREFORE, Plaintiff demands judgment in its favor and against the Defendant(s), Laura
Newbery, in the amount of $29,013.17 plus a reasonable attorney's fee, cost of suit and all other
relief this Court deems just and appropriate.
COUNT II. MONEY LENT
Plaintiff re-alleges and incorporates the allegations contained in the paragraphs contained in
the General Allegations.
11. As of the date of this lawsuit, Defendant(s) owes the Plaintiff a total of $29,013.17.
12. The total amount due is subject to increase due to the ongoing accumulation of costs and
fees.
WHEREFORE, Plaintiff, demands judgment against the Defendant(s) for the sum of
$29,013.17 plus costs, plus or minus any payments, debits or credits posted to the account (if any).

. Defendant(s) has/have failed to pay Plaintiff or Plaintiff's predecessor in interest for the
extension of credit, money, goods, or services.
. It would be inequitable for Defendant(s) to retain the benefit of the extension of credit,
money, goods, or services received by Defendant(s) without paying Plaintiff for same.
. The failure of Defendant(s) to pay the Plaintiff or Plaintiff's predecessor in interest for the
extension of credit, money, goods, or services has caused the Defendant(s) to be unjustly
enriched at the expense of the Plaintiff.
. As of the date of this lawsuit, Defendant(s) owes the Plaintiff a total of $29,013.17. This

In return for a loan that I have received, I promise to pay U.S.$ 30,400.00 (this amount will be called
“*principal’’), plus interest, to the order of the Lender. The Lender is

4. BORROWER’S FAILURE TO PAY AS REQUIRED
(A) Late Charge for Overdue Payments

(B) Notice from Note Holder
If I do not pay the full amount of each monthly payment on time, the Note Holder may send me a written notice telling me
that if I do not pay the overdue amount by a certain date I will be in default. That date must be at least 10 days after the date on
which the notice is mailed to me or, if it is not mailed, 10 days after the date on which it is delivered to me,
(C) Defautt
If 1 do not pay the overdue amount by the date stated in the notice described in (B) above, I will be in default. If I am in
default, the Note Holder may require me to pay immediately the full amount of principal which has not been paid and all the
interest that I owe on that amount.
Even if, at a time when I am in default, the Note Holder does not require me to pay immediately in full as described above,
the Note Holder will still have the right to do so if I am in default at a Jater time.
