TO ALL PARTIES AND THEIR ATTORNEYS OF RECORD:
On April 15, 2014, at 9:30 a.m., in Department 302 of this Court, located at 400 McAllister
Street, San Francisco, CA 94102, the Motion for Preliminary Injunction filed by Plaintiff Bently
Biofuels Company, LLC, d/b/a Bently Biofuels Collection Services, LLC (“Bently”) came before
the Court on regular hearing. Having considered all papers, evidence, and arguments submitted in
support of, and opposition to, said objections, and GOOD CAUSE APPEARING, the Court makes
the following order:
Plaintiff's Motion is granted in part and denied in part. Defendant K. David Fisher and/or
any other employee of Defendant 3D Oil & Grease are enjoined from:
(1) misrepresenting themselves as having any current affiliation with Bently Biofuels
or Got Grease;
(2) wearing a Bently Biofuels or Got Grease uniform while performing activities in the
scope of their employment at 3D Oil & Grease;
(3) moving or altering a Bently Biofuels or Got Grease oil collection container without
the express written permission of Bently Biofuels;
(4) collecting oil from a Bently Biofuels or Got Grease oil collection container without
the express written permission of Bently Biofuels; and
(5) collecting oil from an oil collection container that the 3D Oil & Grease employee
knows is intended to be collected by Bently Biofuels without the express written permission of
Bently Biofuels.
Motion denied as to soliciting Bently's customers. Identity of businesses that use cooking
oil is not confidential. Bently has produced no evidence that Fisher misappropriated confidential
information.
