On this day, came on for consideration Defendant City Masonry, Inc.’s Motion to Limit
Testimony of Dr. Kenneth G. Berliner. The Court, having considered the motion, the response,
and the evidence and arguments presented, is of the opinion that the testimony of Dr. Kenneth G.
Berliner shall be limited to opinions of past medical care as contained within the medical records
which are currently on file with the court. It is accordingly,
ORDERED, ADJUDGED and DECREED that Defendant’s Motion to Limit Testimony
of Dr. Kenneth G. Berliner be GRANTED.
ORDERED, ADJUDGED and DECREED that Plaintiff is excluded from presenting any
evidence or testimony of future economic damages through Dr. Kenneth G. Berliner, including
any alleged future medical care, costs, impairment, disfigurement, disability, or employability
issues.
