(hereinafter referred to as “COURTER”), TREADWELL CORPORATION (hereinafter referred to as “TREADWELL”), TISHMAN LIQUIDATING COMPANY (hereinafter referred to as “TISHMAN”) and OAKFABCO, INC (hereinafter referred to as “OAKFABCO”). As such, I am fully familiar with the facts and circumstances set forth herein. I am submitting this letter in opposition to any anticipated requests for a joint trial of the six (6) cases: Stanley J. Krevetski (105480/01); William T. Stadler (113986/99); James R. Stander (123615/99); Levi H. Walton (104743/99); Alexnader J. Abramski (102657/01); John F. Strauss (105670/99). In the interests of brevity and judicial economy, the four (4) aforementioned defendants hereby adopt the facts and legal arguments as set forth in the letter, on behalf of Kentile Floors, Inc., dated November 5, 2010. We do not believe these cases should be joined on the grounds that they are not trial ready as there have been no depositions conducted in four (4) out of the six (6) cases. Furthermore, plaintiffs’ counsel has not submitted expert reports for any of these cases. Joinder of these six (6) matters involve different work sites, occupations and time frames of exposure and therefore would result in substantial prejudice to all four (4) defendants.
