Dear Justice Bransten:
We represent Respondents/Defendants U.S. Education Loan Trust IV, LLC, U.S.
Education Loan Servicing, LLC, and Dr. Henry B. Howard (“Respondents”). I write pursuant to
Your Honor’s Individual Rules to request an adjournment of the oral argument on Petitioner’s
Motion for Leave to Renew its Motion for Summary Judgment (Motion Seq. No. 011), currently
scheduled for October 22, 2015.
Presumably due to intervening schedule changes, the Court set oral argument on
Petitioner’s Motion on a date other than the one that the parties had confirmed would work for
all counsel when we were before Your Honor last week. Unfortunately, I have an unavoidable
conflict on that date. The parties have conferred and all parties are available on October 19, 21,
23, 26 or 28. We respectfully request that the oral argument be rescheduled for one of those
alternate dates. This is Respondents’ first request for an adjournment and all parties consent to
this request.
