We represent defendant Northville Industries Corp. (“Northville”) in this matter.
Northville’s motion to dismiss plaintiffs’ original complaint is returnable before Your Honor on
Thursday, February 14, 2013. In response to Northville’s motion, plaintiffs served an amended
complaint on January 24, 2013, Since the amended complaint supersedes the original, Northville
is respectfully withdrawing its motion to dismiss without prejudice to the filing of a new motion
to dismiss addressed to the amended complaint.
Pursuant to the stipulation of counsel, Northville will be filing its motion to dismiss the
amended complaint on or before March 15, 2013.
