The plaintiff moves, pursuant to CPLR ~ 3215, for a judgment
by default.
This is an action to recover a 2005 BMW for a default in
payment of the parties' security agreement. An applicant for a
default judgment must file an affidavit setting forth proof of
the facts constituting the claim, the default and the amount due
plaintiff (CPLR ~ 3215(f); Woodson v Mendon Leasing Corp., 100
N.Y.2d62 [2003]).
The affidavit and verified complaint annexed to the moving
papers are sufficient to establish this criteria. Accordingly,
the motion is granted without opposition
