S. § SMITH COUNTY, TEXAS § A CHILD § 321ST JUDICIAL DISTRICT ORDER EXTENDING EMERGENCY ORDERS PURSUANT TO TEXAS FAMILY CODE §262.103 On September 17th, 2015, the Department of Family and Protective Services’ Motion for Extension ofPrior Emergency Orders pursuant to Texas Family Code §262.103 was presented to the Court. 1. Jurisdiction The Court, after examining the record and hearing the evidence and arguments 0f counsel, finds that all necessary prerequisites of the law have been satisfied and that this Comt has jurisdiction of this case and of all panies. 2. Findings The Court finds that the Department of Family and Protective Services has shown good cause for an extension of the prior Emergency Orders as provided for by §105.001, Texas Family Code, Rule 680, Texas Rules of Civil Procedure, and §262.103, Texas Family Code. The Court finds that it is in the best interest of the child named above to continue the appointment of the Department of Family and Protective Services as Temporary Managing Conservator of the child and that immediate and irreparable injury, loss, or damage, for which there is n0 adequate remedy at law, will result to the above named child unless the following Orders are issued. IT IS ORDERED that a hearing in the above numbered Coun is scheduled for: Segtember 24th, 2015 at 1:30 p.m., at which time Department 0f Family and Protective Services is Ordered to show cause why the child should remain in the Temporary Managing Conservatorship of the Department 0f Family and Protective Services during the pendency of this cause or until further orders of this Court. A Respondent, who is not present at the show cause as scheduled above and has not received notice, Respondent may request a show cause hearing atany time during the pendency of this suit. This Order Extending Emergency Orders is granted without notice as the child is inneed of immediate protection, and shallbe effective immediately and remain in fullforce and effect until flirther Orders are issued in this proceeding following the hearing scheduled above.
