DIRECTV,LLC.Index No.652471/2014 Dear Justice Oing: We write on behalf of both parties in the above-captioned action with regard to the compliance conference scheduled for July 23, 2015, and the discovery schedule for the remainder of this action. On June 1, 2015, Smithsonian Networks filed with the Appellate Division, First Department("Appellate Division"), a motion for a stay of enforcement of the Apri129 and May 27 Orders issued by this Court pending Smithsonian Networks' appeal of those orders. On June 25, 2015, the Appellate Division granted the stay pending the Appellate Division's decision on the appeal on the condition that the appeal is perfected for the October 2015 Term, and directed the Clerk to calendar the appeal for the first date in the fall convenient to the Court. In accordance with that decision, Smithsonian Networks will perfect its appeal by August 10, 2015 for the October term. Both parties agree that it would be efficient to stay all discovery in the case pending a decision by the Appellate Division of the appeal, and that it would not be efficient to proceed with discovery on some issues while a decision on other discovery issues is pending on appeal. Accordingly, we file with this letter a stipulation and agreement adjourning the compliance conference scheduled for July 23, 2015 and otherwise staying proceedings in this matter until after the Appellate Division issues a decision on Smithsonian Networks' appeal. If the Court is amenable to so-ordering the stipulation, the parties will inform this Court when the Appellate Division issues its decision and work with the Part Clerk to reschedule the compliance conference for the first available date convenient to the Court and lead counsel for each party.
