from two orders and decisions of the Commercial Division of the New York State Supreme
Court, the Honorable Justice Oing, entered in Index No. 652471/2014: (1) an April 29, 2015
decision and order entered in the office of the County Clerk the same day ("Competitors'
Agreements Order")(Ex. A), which order denied Smithsonian Networks' motion for protective
order and ordered the production of agreements Smithsonian Networks has with other
distributors, including any related amendments or side letter agreements; and (2)a May 26, 2015
Order for the Production and Exchange of Confidential Information entered in the office of the
County Clerk on May 27, 2015 ("Confidentiality Order")(Ex. B), to the extent that the Order
allows in-house counsel to view information designated Highly Confidential.
