Plaintiffs MAIDEN REINSURANCE COMPANY, as Subrogee of D&E TRANSPORT,
INC., and D&E TRANSPORT, LLC (hereinafter referred to as “D&E Transport”), having
moved this Court for an Order pursuant to CPLR §3215(a) directing the clerk to enter judgment
against the Defendant KATALYST WORLDWIDE, INC. (hereinafter referred to as “Katalyst”),
by reason of their failure to answer the Summons and Complaint and, for such other, further and
different relief as this Court may deem just, proper and equitable; and
Upon the reading the Notice of Motion dated November 6, 2015 and the Attorney
Affirmation In Support of Timothy P. Welch, Esq. dated November 6, 2015 with supporting
exhibits; and
Upon receiving no opposition to said motion from Defendant Katalyst; and
Upon hearing oral argument on behalf of D&E Transport in support of the motion; itis
hereby
ORDERED, that the motion for pursuant to CPLR §3215(a) for judgment against the
Defendant Katalyst by reason of their failure to answer the Summons and Complaint brought on
behalf of plaintiff D&E Transport, is GRANTED in its entirety.
