Kyle Jacobs, Esq., pursuant CPLR 2106 affirms under the penalties of perjury the truth of
the following:
1. I am an attorney at law duly licensed to practice before the Courts of the State of New
York and am associated with the law firm of McCalla Raymer Leibert Pierce, LLC, attorneys for
Plaintiff, JPMorgan Chase Bank, National Association in the above-captioned mortgage
foreclosure action. As such, I am fully aware of the underlying action, as well as the proceedings
has herein.
2. On June 21, 2019, this Court granted Plaintiff a Judgment of Foreclosure and Sale which
was them entered by the County Clerk on June 26, 2019. A copy of the entered Judgment of
Foreclosure and Sale is attached as Exhibit "A".
3. Pursuant to the Judgment of Foreclosure and Sale, the sale shall take place within ninety
(90) days of the entry of the Judgment. However, due to the availability of the Court-Appointed
Referee and the 60-90 day acquisition notice required to be given to the mortgagor for mortgages
insured by the U.S. Department of Housing and Development pursuant to 24 CFR § 203.675, the
sale can not be scheduled prior to the September 24, 2019 deadline.
4. Accordingly, Plaintiff respectfully requests an extension of time to set sale.

WHEREFORE, it isrespectfully requested that an Order be entered extending the time to
set sale of the Mortgage Premises of the subject property of the Mortgage and Note being
foreclosed in this action as for such other and any further relief this Court deems just, proper, and
equitable.
