Upon the foregoing papers, it is ordered thatthis motionis and adgudged har:
The court grants plaintiff’s unopposed motion to vacate its
default in appearing for its prior motion for a default judgment
and to vacate the order dated June 23, 2016, which denied that
motion. C.P.L.R. § 5015 (a) (1). The court also grants
plaintiff's motion for a default judgment, C.P.L.R. § 3215, based
on the evidence supporting plaintiff's prior motion for a default
judgment presented in support of this motion for the vacatur.
Defendant is liable for nonpayment of (1) $26,400.00 for
transportation services plaintiff provided to defendant between
August 21 and October 23, 2012, and (2) $1,439.18 for defendant's
hotel bill plaintiff paid for defendant at her request October 5,
2012: a total of $27,839.18. Therefore the Clerk shall enter a
judgment for $27,839.18 in favor of plaintiff and against
defendant, with interest on $26,400.00 from September 22, 2012,
the midpoint of the unpaid transportation charges, and interest
on $1,439.18 from October 5, 2012. C.P.L.R. § 5001(a) and (b).
