                           PLEASE TAKE NOTICE, that upon the annexed affirmation of Ira N.                        Glauber,    Esq.,

                  dated October 7,     2016,  and the exhibits annexed thereto        and the annexed Memorandum of Law,

                  and all prior proceedings previously had herein, Plaintiff Edson Ricci, will move this Court

                  before the Hon.     Lucy Billings, J.S.C., at Motion Submission Part, Room              130,  at the Courthouse

                  located at 60 Centre Street, New York, New York,             on October 21, 2016 at 9:30 a.m., or as soon

                  thereafter as counsel may be heard, for an Order pursuant to             CPLR    § 2221(d) granting leave to

                  reargue Plaintiff Edson Ricci’s       (“Ricci”) Motion for Default Judgment, which resulted in the

                  Order of Justice Billings, dated June 23, 2016 and entered on September 28,                 2016 (the “Order”)

                  and, upon reargument,       granting Ricci’s Motion for Default Judgment,           and for such other and

                  further relief as the Court deems just and proper.

                           PLEASE TAKE           FURTHER NOTICE, that pursuant to                CPLR     § 22 14(b), responsive

                  papers are required to be served upon the undersigned at least two              (2) days prior to the return

                  date of the motion.
